Terms of Service

By creating an account, uploading content, or otherwise using the LKK Records platform, you agree to these Terms of Service, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform.

LKK Records reserves the right to modify these terms at any time. We will notify registered users of material changes via email or through the platform. Your continued use of the platform after such modifications constitutes your acceptance of the updated terms.

To use LKK Records services, you must be at least 18 years of age, or at least 13 years of age with verifiable parental consent in compliance with the Children's Online Privacy Protection Act (COPPA). During registration, you will be required to confirm your age category. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

If you are under 18 years of age, you represent and warrant that you have obtained explicit permission from a parent or legal guardian to create an account and use our services. Parents and guardians are legally responsible for all activities of minors using the platform.

You agree to provide accurate, current, and complete information during registration and to keep it updated. Providing false information, including misrepresenting your age, will result in immediate account termination and may expose you to legal liability.

Each person or entity may only create one account. Multiple accounts by the same individual or entity are strictly prohibited and may result in suspension of all accounts without prior notice.

You retain all ownership rights to the music, artwork, and other content you upload to LKK Records. By uploading content, you grant LKK Records a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and display your content solely for the purpose of providing our services and promoting your music.

You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions for any content you upload, including musical compositions, sound recordings, artwork, and metadata. You are solely responsible for ensuring that your content does not infringe upon the intellectual property rights of any third party. LKK Records assumes no responsibility for user-uploaded content and is not liable for any third-party claims arising from your content.

LKK Records reserves the right to remove any content that violates these terms, infringes on third-party rights, or is otherwise objectionable at our sole discretion.

LKK Records provides music distribution services to deliver your content to streaming platforms, digital stores, and other music services. We will make commercially reasonable efforts to deliver your music to the platforms you select, but we cannot guarantee acceptance by any specific platform.

Release timelines are estimates only and may vary depending on platform requirements, quality control processes, and external factors beyond our control. Typical delivery times are 2–5 business days, but some platforms may require longer. LKK Records is not liable for delays caused by third-party platforms.

Once a release is live on streaming platforms, changes or takedowns may take 24–48 hours or more to process. You remain solely responsible for ensuring all metadata and content is accurate before submission. LKK Records is not responsible for errors in content submitted by users.

LKK Records collects royalties from streaming platforms and digital stores on your behalf. Royalties are typically reported 2–3 months after the end of the month in which streams occurred, depending on when platforms provide their data to us. Royalty reporting timelines are estimates and are not guaranteed.

The minimum payout threshold is $11.00 USD (or equivalent in applicable currency). Payouts are processed within a commercially reasonable timeframe after approval. LKK Records is not liable for delays attributable to third-party payment processors.

You are solely responsible for all taxes associated with royalty payments in your country of residence. LKK Records does not provide tax advice and recommends consulting with a qualified tax professional. LKK Records may be required to collect tax documentation where applicable under Dutch tax law (Algemene wet inzake rijksbelastingen — AWR) or the tax laws of the relevant jurisdiction.

Commission Structure: LKK Records itself does not take any commission from your royalties. However, our private distribution partner, who handles delivery to streaming platforms, retains 10% of gross royalties collected. You receive 90% of all royalties generated. This fee is automatically deducted before royalties appear in your account balance.

In cases of fraudulent streaming activity, artificial stream manipulation, chargebacks, or other violations, LKK Records reserves the right to withhold, deduct, or reclaim payments and to terminate your account without notice.

When using LKK Records, you agree not to:

• Upload content that you do not have the legal right to distribute
• Engage in or promote artificial streaming, playlist manipulation, or other fraudulent activities
• Upload content containing malware, viruses, or harmful code
• Impersonate another person or entity, or falsely claim affiliation with any organization
• Use the platform to distribute hate speech, harassment, threats, or content that violates applicable law
• Attempt to gain unauthorized access to other users' accounts or our systems
• Scrape, data mine, or use automated tools to extract data from the platform without permission
• Circumvent or manipulate our payment systems, royalty reporting, or any other platform functionality

Violation of these prohibitions may result in immediate account suspension or termination, forfeiture of royalties, and potential civil or criminal legal action.

LKK Records strives to maintain high availability, but we do not guarantee uninterrupted or error-free service. The platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage arising from service interruptions.

We reserve the right to modify, suspend, or discontinue any aspect of the platform at any time, including features, functionality, or integration with third-party services, with or without notice.

The LKK Records platform, including its design, functionality, code, branding, and documentation, is protected by Dutch and international copyright, trademark, and other intellectual property laws (including the Auteurswet (Dutch Copyright Act) and the Benelux Convention on Intellectual Property (BCIP)). All rights not expressly granted to you are reserved by LKK Records.

You may not copy, modify, distribute, sell, or lease any part of our services or software, nor may you reverse engineer or attempt to extract the source code of our platform.

Trademark Protection: The LKK Records name, logo, branding elements, and all related trademarks are the exclusive property of LKK Records. You are strictly prohibited from using, copying, imitating, or creating any company, service, product, or brand that uses the LKK Records name, logo, or any confusingly similar marks. Unauthorized use constitutes trademark infringement under the Benelux Convention on Intellectual Property (BCIP) and EU trademark regulations and may result in:

• Immediate cease and desist demands
• Injunctive relief
• Claims for actual and statutory damages
• Recovery of legal fees

The underlying platform technology is provided by enarumusic Benelux (Netherlands). No rights in the underlying technology are granted to users of LKK Records.

THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING DUTCH LAW (BURGERLIJK WETBOEK ART. 6:74), LKK RECORDS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

LKK RECORDS DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU USE THE PLATFORM ENTIRELY AT YOUR OWN RISK.

LKK RECORDS (AS THE PLATFORM TECHNOLOGY PROVIDER, MAKES NO WARRANTIES OF ANY KIND WITH RESPECT TO THIS PLATFORM OR ITS OPERATIONS AND IS NOT RESPONSIBLE FOR ANY ASPECT OF LKK RECORDS'S SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LKK RECORDS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.

Our aggregate liability for any claims arising from your use of the platform shall not exceed the total amount you paid to LKK Records in the twelve months preceding the claim, or €100.00 EUR, whichever is greater. Liability for intentional misconduct or gross negligence (opzet of bewuste roekeloosheid) remains unaffected as required by Dutch law (Burgerlijk Wetboek Art. 6:74).

LKK RECORDS SHALL HAVE NO LIABILITY WHATSOEVER TO USERS OF THIS PLATFORM. LKK RECORDS'S SOLE RELATIONSHIP IS WITH LKK RECORDS AS A TECHNOLOGY PROVIDER, AND LKK RECORDS IS NOT A PARTY TO ANY TRANSACTION, AGREEMENT, OR DISPUTE BETWEEN LKK RECORDS AND ITS USERS.

These limitations apply to the maximum extent permitted under applicable Dutch law and EU consumer protection regulations. Mandatory statutory rights are not affected.

You agree to indemnify, defend, and hold harmless LKK Records and its respective affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the platform; (b) your content; (c) your violation of these terms; (d) your violation of any applicable law; or (e) your infringement of any third-party rights.

You may terminate your account at any time by contacting support@lkkrecords.distrosupport.com. Upon termination, you will forfeit access to the platform and any pending royalties below the minimum payout threshold.

LKK Records may suspend or terminate your account at any time, with or without notice, for violation of these terms, fraudulent activity, or for any other reason at our sole discretion. We will make reasonable efforts to provide notice before termination except where immediate action is required.

Upon termination, your content may be removed from streaming platforms within 24–48 hours, though some platforms may require longer. LKK Records is not responsible for delays in content removal by third-party platforms.

These Terms of Service are governed by and construed in accordance with the laws of the Netherlands, excluding its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply. Any disputes arising from these terms or your use of the platform shall be resolved exclusively in the courts of Amsterdam, the Netherlands.

Online Dispute Resolution (EU): As required by EU Regulation No 524/2013, we refer you to the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr. LKK Records is not obligated to participate in out-of-court dispute resolution proceedings before a consumer arbitration board, but we will make every effort to resolve disputes amicably.

Before initiating any legal proceedings, you agree to first attempt to resolve disputes through good faith negotiations by contacting support@lkkrecords.distrosupport.com.

Note: LKK Records is a Netherlands-incorporated company. All disputes are governed by Dutch law and subject to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands.

Entire Agreement: These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and LKK Records regarding use of the platform and supersede all prior agreements.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver: Failure by LKK Records to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. LKK Records may assign its rights freely.
